Terms of Use

1. Scope

These Terms of Use apply to the use of the web application MerchScout (hereinafter “Platform”), operated by:

By registering, the user accepts these Terms of Use. Deviating terms of the user are not recognized unless we expressly agree to their validity in writing.

2. Description of Services

MerchScout is an AI-powered platform for print-on-demand sellers. The platform offers, among other things:

  • Niche analysis and scoring
  • Seasonal calendar with relevant events
  • Trend overviews and keyword data
  • AI-generated market assessments

We reserve the right to modify, expand, or restrict the functionality of the platform at any time, provided this is reasonable for the user.

3. Registration and Account

Registration with a valid email address is required to use the platform. The user is obliged to provide truthful information and to keep their login credentials confidential.

The user is liable for all activities that take place under their account. If unauthorized use is suspected, the user is obliged to inform us immediately.

4. Free and Paid Use

The platform offers a free plan with limited functionality. Extended features are available through paid subscriptions.

Payments are processed by Polar Software, Inc., 3500 South DuPont Highway, Dover, DE 19901, USA, as Merchant of Record. Polar handles all payments, invoices, and sales tax. Polar also handles all payment-related customer inquiries and refunds. Subscriptions renew automatically for the respective billing period unless cancelled before the end of the current term.

Cancellation of a subscription is possible at any time, effective at the end of the current billing period. Amounts already paid for the current period are not refunded.

5. Usage Rights and Obligations

The user receives a non-exclusive, non-transferable right to use the platform within the scope of these Terms of Use.

The user is specifically prohibited from:

  • Using the platform for unlawful purposes
  • Performing automated access (scraping, bots) to the platform unless expressly permitted
  • Decompiling, reverse-engineering, or otherwise analyzing the platform or its content
  • Sharing login credentials with third parties or sharing accounts

6. Intellectual Property

All content on the platform (texts, graphics, software, databases) is protected by copyright and is the property of MuchWerk UG (haftungsbeschränkt) or its licensors.

The analyses and market assessments provided by the platform may be used by the user for their own business purposes. Redistribution or publication of raw data and analyses is not permitted without prior written consent.

7. Liability and Warranty

The analyses, evaluations, and recommendations provided through the platform are AI-generated assessments and do not constitute a guarantee of business success. The user makes business decisions based on platform data at their own responsibility.

We are liable without limitation for intent and gross negligence. In cases of slight negligence, we are only liable for breach of essential contractual obligations (cardinal obligations), limited to the foreseeable, contract-typical damage.

We strive for high availability of the platform but cannot guarantee uninterrupted accessibility. Maintenance work and technical disruptions may lead to temporary restrictions.

8. Data Protection

Information on the processing of personal data can be found in our Privacy Policy.

9. Termination and Account Deletion

The user may delete their account at any time. Upon deletion, all personal data will be removed unless statutory retention obligations apply.

We reserve the right to suspend or delete accounts in case of violation of these Terms of Use.

10. Changes to the Terms of Use

We reserve the right to amend these Terms of Use. We will inform the user of material changes by email. Continued use of the platform after the changes take effect constitutes acceptance.

11. Final Provisions

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Berlin, to the extent permitted by law.

Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall not be affected.
